Harold F. Babb, the former director of Eyak Technology LLC or EyakTek was sentenced today in the bribery and kickback case that came to light in October of 2011.
Babb was the director of EyakTek’s Dulles, Virginia office from 2006 until the time of his arrest in October of 2011. Babb admitted to a scheme that involved the U.S. Corps of Engineers and two contracts, the Technology for Infrastructure, Geospatial, and Environmental Requirements (TIGER) contract, and the Contingency Operations Readiness Engineering and Support (CORES) contract.
The TIGER contract was used by authorized federal government agencies and departments to purchase products and services. The CORES contract was a planned contract, envisioned as an alternative or potential replacement to the TIGER contract.
Babb admitted to carrying out the scheme with others that included Kerry F. Khan and Michael A Alexander. Those two were program managers with the Corps of Engineers. Also involved were Alex N. Cho who was the former chief technology officer of Nova Datacom, LLC, and James Edward Miller the owner of Big Surf Construction Management LLC.
The bribery charge stems from Babb’s payments and promises to Khan in return for Khan’s approval on contracts and subcontracts awarded through the Army Corps of Engineers to EyakTek and Big Surf Construction Management. All told, Babb pled guilty to providing, offering, and promising more than $7 million, directly and indirectly, to Khan.
The kickback charge stems from Babb’s dealings with Cho and Nova Datacom. Babb pled guilty to soliciting, accepting, and attempting to accept more than $1 million in kickbacks from Cho and Nova Datacom in return for giving the company preferential treatment on subcontracts.

In 2008, Babb and Khan conspired to use Big Surf Construction to obtain subcontracts from EyakTek. They never intended for Big Surf to provide equipment and services, rather, they agreed to submit fictitious orders to the Corps of Engineers and EyakTek through Big Surf then split the proceeds amongst themselves. Through the subcontracts awarded, they funneled $8 million to Big Surf.
Babb, Khan, Alexander and Cho also worked together to steer the CORES contract to Nova Datacom. Babbs was offered future employment as well as other benefits for his work steering the contract to Nova Datacom. That scheme was thwarted by the arrests made in October. That contract was worth $790 million and would have been increased to $1 billion when Nova Datacom would have sought an additional 25% increase in the award.
Babb pled guilty to Bribery and Kickbacks in March of this year.
Babb was sentenced today to seven years three months for his part in the scheme.
