Despite her fiancee’s desire that she doesn’t receive more jail time than she has already served, Fairbanks Superior Court Judge Michael McConahy handed down a sentence of 20 months on Monday to the Fairbanks woman, 32-year-old Lindsey Preshaw, who stabbed her fiancee/step brother John Preshaw in the lower leg with a butcher knife last June.
Although she pleaded guilty last fall to Felony Assault III, her sentencing was delayed by continuations and rescheduling. Her original sentencing hearing was scheduled for the first week in April. Mr. Preshaw also had attempted to have the charges dismissed, but was unsuccessful in doing so.
L. Preshaw was on probation for assaulting a police officer when the most recent offense occurred. She had been sentenced to 360 days in jail with 180 days suspended and three years probation in that case.
L. Preshaw’s court records show two DUIs and three previous assaults in the previous ten years.
Although the case was not dismissed as her fiancee would have liked, L. Preshaw’s sentence was far less than the sentence asked for by the prosecution. They had asked for four years from the judge. Several people attended court asking for leniency in the sentencing.
It has not yet been determined if L Preshaw will serve her remaining 9 months of her sentence by electronic ankle monitoring, at a halfway house or in jail. She has until August 15th to report to do her time. She has been credited for the 11 months already served on the offense.
