At shortly after 11 pm on Saturday night, Alaska State Troopers observed a 2002 Isuzu Trooper performing moving violations. They immediately stopped the vehicle.
When the vehicle was stopped on Cruzy Street, they found Tammy Gardner, 43, of Wasilla, was under the influence behind the wheel. She was arrested for DUI.
Also in the vehicle was James Gardner, age 45, of Wasilla. James was the registered owner of the vehicle. He requested that the vehicle be left there at the location rather than be towed. He told the troopers from the South Central team that he would retrieve the vehicle in the morning. Officers smelled the odor of alcohol on Gardner when conversing with him. They agreed to leave the vehicle at the scene.
Tammy Gardner was transported and remanded to Mat-Su Pretrial on charges of DUI and her bail was set at $1,000.
A short time later, troopers returned to find the vehicle gone. They responded to Gardner’s residence at 11:41 to find that he was home and still smelled strongly of alcoholic beverages. A witness at the scene admitted to the troopers that Gardner had indeed driven the Isuzu home. Gardner was placed under arrest for DUI. Further investigation found that Gardner had a restricted license. The restriction required that Gardner have an IID installed in his vehicle. The Isuzu was not equipped with the device. Because of this, Gardner was also charged with a violation of his restricted license.
James Gardner was also placed under arrest and transported to the Mat-Su Pretrial facility and remanded there with a $5,000 bail and a third party court approved custodian.
