The case stems from an incident oin April of 2012 when Modeste was fleeing from officers. Modeste, also known as “Simba,” was at the Merrill Field Inn at the time of the contact. Modeste threw a Smith and Wesson. 357 caliber revolver from the hotel window and followed behind it as he sought to get away from the officers. The weapon landed in the snow bank.
Further investigation of the vehicle, a Buick Sedan, that Modeste traveled in to get to the Merrill Field Inn room, was found to contain another handgun, this one a Taurus 45 caliber revolver, under the driver’s side seat.
Modeste is prohibited from possessing weapons as a result of a felony conviction of Manslaughter in 2005.
It was in January of that year that police were called to a Spenard residence regarding a double shooting that had taken place there. Police arrived to find 40-year-old Aaron Roberts dead from a gunshot wound to the head. Roberts would later die from his injuries.
Also found at the scene was Daquan Stinson. Stinson had suffered a gunshot wound to the chest. Stinson would survive the incident.
Stinson had told police that Modeste and Roberts had been arguing over a woman that Modeste had beaten up over a drug deal, according to court documents.
Modeste also has other criminal convictions on his record involving drugs, weapons and violence.
Modeste’s next hearing is in July when he is sentenced. Judge Burgess can sentence Modeste to up to 10 years in prison for this most current offense. But, the actual sentence will be determined by the seriousness of the offense and Modeste’s criminal history.
