A police officer with the Newton Police Department in New Jersey is suspended without pay pending the outcome of a criminal case in which charges of Official Misconduct and Lewdness were leveled at him after an investigation found he had exposed himself to numerous young male drivers in that state.

37-year-old Newton policeman, Jason Miller was arrested on Monday and is currently free on $35,000 bail. He was arrested after an Affidavit of Probable Cause was filed by the Sussex County Prosecutors Office.

The investigation into Miller’s indecent conduct was opened in late October after a confidential tip-line at the Newton Police Department received an email  from an anonymous complainant “alleging that a Newton Police Officer exposed himself during a traffic stop in the town of Newton” that occurred in late October.

The department was able to ascertain the identity of the tipster as a 22-year-old man and the videotape of the traffic stop  corroborated the man’s complaint.

Investigators went to the young man’s address and contacted him for an investigative interview according to the affidavit. During the interview, the man told investigators that on the evening of October 22nd, he was pulled over by Miller after leaving O’Reilly’s Pub and when stopped, he “noticed the officer’s zipper was down and he saw what appeared to be something skin colored.”

The man, identified only as A.B., also related to the investigators that he also knew that a friend of his had also been pulled over by an officer resulting in similar actions by the officer. The investigation widened when A.B. supplied the investigators with the name of his friend and his cell phone number.

When that man, only identified as K.K. was contacted, he told investigators that he and a friend had been out with friends for the evening when they were pulled over weeks earlier. The officer that pulled him over asked K.K. if he noticed that the officer’s zipper was down, K.K. responded in the negative. After dropping his friend off and leaving, K.K. told investigators that he found himself being followed by the same officer, who again pulled him over and once again asked if he noticed that the officer’s zipper was down, when he replied “no” once again, the officer asked him if the person he had dropped off was his boyfriend. When K.K. answered  “no” and told the officer he had a girlfriend. The officer told him to have  good night and left the scene, K.K. said.

Because K.K. had traveled past the Newton Police Station, surveillance cameras picked up the two vehicles as they moved past the building and it was determined that the officer in question was indeed Miller. Video from Miller’s patrol car again showed what appeared to be Miller’s penis on footage of the tape.

Because videos corroborated what the two men alleged happened, investigators decided to check other traffic stop videos made by Miller. In those videos they found further evidence that Miller had exposed himself to several young male drivers in the previous months.

One of those additional driver interviewed, identified only as J.A., said that he was pulled over on September 2nd, and reported that when pulled over he saw that the officer’s zipper was down and his genitals were exposed. After the traffic stop was concluded, J.A. said he saw the officer zipping up his pants as he went back to his patrol car. Despite his registration and insurance  being expired, he was not issued a ticket.

J.A. told investigators that when he later met with his 16-year-old girlfriend, he told her about the traffic stop and the officer’s indiscretion. When interviewed, J.A.’s girlfriend confirmed that J.A. had told her that J.A. had said the officer’s “junk was hanging out.”

Despite there being evidence of traffic violations in many of the stops, that included probable DUIs, Miller did not issue any citations, according to the affidavit.

The investigation into Miller’s misconduct is continuing.

According to his attorney, Miller “vehemently denies” the allegations.
